Echo Valley license agreement
Keymajor LLC ("we", "us"), which operates echo-tone.com, licenses Echo Valley (the "Software") to you on the terms below. Installing or using the Software means you accept them. If you do not accept them, do not install the Software.
1. What You Get
We grant you a personal, non-exclusive, non-transferable license to install and use the Software on up to three (3) computers that you own or personally control. You may use it for any purpose, commercial or otherwise, including music you sell.
2. What You May Not Do
You may not share, resell, rent, lend, sublicense or distribute the Software or your license key. You may not remove or work around the licensing, and you may not reverse engineer, decompile or disassemble the Software except where that right cannot lawfully be excluded.
Your license key identifies you. If it appears in public distribution, we may deactivate it.
3. Your Music Is Yours
We claim no rights over anything you make with the Software. Audio you produce is yours entirely, with no royalty, credit or reporting obligation.
4. Updates
Updates to Echo Valley are included at no additional cost for as long as we continue to develop it. We are not obliged to produce updates, to support any particular operating system version, or to maintain compatibility with any particular host.
5. Trial Version
The trial runs for four (4) days from activation and is for evaluation only. When it ends the Software stops producing audio until a license is activated. Interfering with the trial period is a breach of this agreement.
6. Activation And Privacy
Activating requires an internet connection once. We store your name, email address and order reference in order to issue and manage your license, together with an anonymous identifier for each computer you activate, so that the three computer limit can be applied. Starting a trial records the same anonymous identifier. After activation the Software does not require an internet connection and does not transmit information about you or your work. 7. No Warranty
The Software is provided "as is". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Software will be uninterrupted or error free, or that it will work with every host or system.
8. Limitation Of Liability
To the fullest extent permitted by law, our total liability arising out of or related to the Software is limited to the amount you paid for it. We are not liable for indirect, incidental, special or consequential damages, including lost work, lost recordings, lost profits or lost time, even if advised of the possibility.
Nothing here excludes liability that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have rights under local consumer law that this agreement does not affect.
9. Termination
This license ends if you breach it. On termination you must stop using the Software and remove it from your computers.
10. Governing Law
This agreement is governed by the laws of the State of Illinois, United States, without regard to conflict of law rules.
